Appel à la décision du tribunal administratif de Cayenne

Par une décision du 25 octobre 2021, suite au référé du syndicat des hôteliers, cafetiers et discothèque de Guyane, le juge des référés a ordonné :

• de suspendre l’interdiction d’ouverture des restaurants, débits de boissons et commerces ambulants en zone orange ;
• par dérogation au couvre-feu en zone orange, d’autoriser l’ouverture des restaurants et débits de boissons jusqu’à 22H30 tous les jours, y compris le dimanche ;
• que les restaurants et débits de boissons appliquent les règles de fonctionnement prévues en zone verte à savoir accueil uniquement en terrasses et en salle avec purification de l’air et contrôle du pass sanitaire pour les clients et le personnel en contact avec le public.

Le juge des référés a par ailleurs indiqué que la suspension prendra effet 36 heures après notification de son ordonnance.

Compte tenu du taux d’incidence encore très élevé sur le territoire (à 227 pour 100 000 habitants au 26 octobre), de la quatrième vague très mortifère qui sévit encore sur le territoire, du faible taux de vaccination qui laisse présager encore beaucoup trop de cas graves et au vu d’une tension hospitalière forte, l’État a décidé d’interjeter appel auprès du Conseil d’État de cette décision.

Cet appel n’est pas suspensif. Dans l’attente de la décision du Conseil d’État, le Préfet de la région Guyane, Thierry QUEFFELEC, a pris un nouvel arrêté ce jour qui se conforme à l’ordonnance du juge des référés en étendant l’ouverture en terrasse et en salle avec purification de l’air des restaurants, débits de boissons et commerces ambulants à la zone orange*, selon les conditions déjà établies pour la zone verte. Le pass sanitaire s’applique dans l’ensemble des établissements rouverts.

La mesure de couvre-feu continue à s’appliquer avec une dérogation désormais prévue jusqu’à 22h30 pour les personnes se rendant dans un restaurant ou un débit de boissons.

Ces mesures seront réexaminées à l’aune de la décision du Conseil d’État et de l’évolution de la situation sanitaire.

By a decision of October 25, 2021, following the summary proceedings of the union of hotels, cafetiers and nightclubs of French Guiana, the summary judge ordered:

• suspend the ban on the opening of restaurants, drinking establishments and itinerant shops in the orange zone;
• notwithstanding the curfew in the orange zone, to authorize the opening of restaurants and drinking establishments until 10:30 p.m. every day, including Sundays;
• that restaurants and drinking establishments apply the operating rules provided for in the green zone, namely reception only on terraces and in rooms with air purification and sanitary pass control for customers and staff in contact with the public.

The summary judge also indicated that the suspension will take effect 36 hours after notification of his order.

Given the still very high incidence rate in the territory (at 227 per 100,000 inhabitants as of October 26), the very deadly fourth wave still raging in the territory, the low vaccination rate which still suggests too many serious cases and in view of high hospital pressure, the State decided to appeal this decision to the Council of State.

This appeal is not suspensive. Pending the decision of the Council of State, the Prefect of the French Guiana region, Thierry QUEFFELEC, issued a new decree today which complies with the order of the judge in summary proceedings by extending the opening to the terrace and in the dining room with air purification in restaurants, drinking establishments and itinerant shops in the orange zone*, according to the conditions already established for the green zone. The health pass applies to all reopened establishments.

The curfew measure continues to apply with an exemption now provided until 10:30 p.m. for people going to a restaurant or a drinking establishment.

These measures will be reviewed in the light of the decision of the State Council and the evolution of the health situation.
