Administration provisoire de l'Association Ciel de Case : précisions de la CTG

La collectivité territoriale de Guyane finance trois associations qui gèrent des établissements accueillant 176 enfants et jeunes confiés à l’aide sociale à l’enfance (717 autres sont pris en charge chez 168 assistantes familiales). La collectivité territoriale a décidé de contrôler le fonctionnement, l’organisation et la prise en charge des enfants admis dans ces établissements, ce qui a fait apparaître de graves irrégularités ayant conduit à la mise sous administration provisoire de deux d’entre eux, l’un géré par l’AGAEJEF et l’autre, géré par l’association Ciel de Case.

S’agissant de cette dernière association, les dysfonctionnements sont récurrents depuis de nombreuses années : rapport IGAS et 1ère administration provisoire en 2007, seconde inspection en 2013 diligentée par le conseil général et seconde administration provisoire, redressement judiciaire 2016-2017, puis troisième inspection par la CTG en mars 2020. Cette dernière inspection a conclu que la poursuite de ces dysfonctionnements justifiait un retrait d’autorisation. L’association a été sollicitée conformément au principe du contradictoire mais n’a pu donner aucune réponse satisfaisante permettant d’envisager un redressement durable, face au non-respect de la réglementation et de la convention collective quant à la qualification des personnels.

Les principaux griefs reprochés à l’association étaient notamment les suivants : multiples et graves dysfonctionnements dans les prises en charge des jeunes admis ; absence d’investissement des équipes sur le projet d’établissement et les projets personnalisés des jeunes ; omniprésence du président, y compris auprès des équipes, sans respect de la répartition des compétences avec le Directeur; recrutement d’une assistante de direction proche de lui sans aucune compétence en secretariat; le management présidentiel a conduit à un niveau élevé de turn over (11 à 25 sorties chaque année);...

La collectivité a donc, conformément au code de l’action sociale et des familles, assumé ses responsabilités de chef de file de la protection de l’enfance et engagé la procédure de mise sous administration provisoire et de transfert d’autorisation.

L’administratrice provisoire a été choisie de par ses compétences professionnelles et nommée le 12 Novembre 2020 pour une période de 6 mois. Elle a immédiatement pris ses fonctions et rassuré les équipes par sa présence et la mise en œuvre d’un plan d’actions.

En parallèle, la collectivité a lancé un appel à candidatures auprès de 6 associations compétentes en matière de protection de l’enfance le 14 Janvier 2021. Une seule a répondu : SOS Jeunesse. Elle a été, auditionnée et à la fois sa proposition de reprise et les précisions apportées lors de cette audition ont conduit à la retenir pour reprendre l’autorisation à compter du 1
er Mai 2021.

En conclusion, la collectivité territoriale a à la fois respecté strictement les textes et choisi le repreneur en parfaite transparence de par ses compétences indéniables. Cette reprise est justifiée par la nécessité d’avoir enfin pour cette maison d’enfants à caractère social (MECS) une association gestionnaire qui garantira une prise en charge exemplaire des enfants et des jeunes qui lui sont confiés, et qui sont particulièrement abimés par leur vie passée.

Aussi, faire circuler des messages diffamatoires et remplis de fausses informations, au-delà de la mise en cause de l’élue en responsabilité de ce champ de compétences, et des équipes qui y travaillent (administrateur provisoire et personnels de la CTG), porte atteinte à la prise en charge de nos jeunes confiés à l’aide sociale à l’enfance. Une attitude pleinement inadmissible et pitoyable de la part de personnes qui faisait passer leurs intérêts personnel savant ceux des jeunes pris en charge, et qui ont donc certainement perdu beaucoup aujourd’hui !

The Territorial Collectivity of French Guiana finances three associations which manage establishments welcoming 176 children and young people in the care of child welfare (717 others are taken care of by 168 family assistants). The local authority decided to monitor the functioning, organization and care of children admitted to these establishments, which revealed serious irregularities which led to the provisional administration of two of them, the one managed by AGAEJEF and the other managed by the Ciel de Case association.

With regard to the latter association, dysfunctions have been recurring for many years: IGAS report and 1st provisional administration in 2007, second inspection in 2013 carried out by the General Council and second provisional administration, receivership 2016-2017, then third inspection by the CTG in March 2020. This last inspection concluded that the continuation of these dysfunctions justified a withdrawal of authorization. The association was approached in accordance with the adversarial principle, but was unable to give any satisfactory response allowing a lasting recovery to be envisaged, in the face of non-compliance with regulations and the collective agreement regarding the qualification of personnel.

The main complaints against the association were in particular the following: multiple and serious dysfunctions in the care of young people admitted; lack of investment by teams in the establishment plan and personalized youth projects; omnipresence of the chairman, including with the teams, without respecting the distribution of powers with the Director; recruitment of an executive assistant close to him without any secretarial skills; the presidential management has led to a high level of turnover (11 to 25 outings each year); ...

The community has therefore, in accordance with the Social Action and Families Code, assumed its responsibilities as a leader in child protection and initiated the procedure for provisional administration and transfer of authorization.

The provisional administrator was chosen on the basis of her professional skills and appointed on November 12, 2020 for a period of 6 months. She immediately took up her duties and reassured the teams by her presence and the implementation of an action plan.

At the same time, the community launched a call for applications from 6 associations with expertise in child protection on January 14, 2021. Only one responded: SOS Jeunesse. It was auditioned and both her proposal for resumption and the details provided during this hearing led to her being retained to resume authorization from 1
May st 2021.

In conclusion, the local authority has both strictly observed the texts and chosen the buyer in complete transparency due to its undeniable skills. This recovery is justified by the need to finally have for this social children's home (MECS) a management association that will guarantee exemplary care for the children and young people entrusted to it, and who are particularly damaged by their past life.

Also, to circulate defamatory messages filled with false information, beyond the questioning of the elected representative in charge of this field of competence, and of the teams who work there (temporary administrator and staff of the CTG), carries damage to the care of our young people entrusted to social assistance for children. A completely unacceptable and pitiful attitude on the part of people who put their personal interests above those of the young people in care, and who have therefore certainly lost a lot today!
