Pollution historique sur une mine d’or : la société GOLD’OR condamnée

Ce vendredi 04 décembre à 8h, la chambre détachée du tribunal correctionnel de Saint-Laurent-du-Maroni a condamné la société GOLD’OR à une amende de 100 000 euros avec sursis pour l’ensemble des faits de pollution qui lui sont reprochés, notamment la pollution sur sa mine d’or en alluvionnaire par rejet volontaire. Les associations de protection de la nature, France Nature Environnement et Guyane Nature Environnement, étaient parties civiles au procès.

Pour rappel, en juillet 2018, les agents de l’ONF ont constaté une pollution record au niveau de la crique Kokioko, sur la commune de Mana, où se situe une mine d’or artisanale détenue par la société GOLD’OR gérée par la famille OSTORERO. Le taux prélevé de matières en suspension était 4 800 fois supérieur à la norme autorisée qualifiant ainsi cette pollution d’historique.

Le Tribunal a aujourd’hui sanctionné ces faits de pollution en condamnant la société minière à une amende de 100 000 euros avec sursis et 1 euro symbolique au titre du préjudice écologique, une première en Guyane. Il lui a été notamment reproché le fait d’avoir volontairement ouvert les digues engendrant un déversement important de boue dans le cours d’eau asphyxiant ainsi tous les organismes vivants présents.
Face à cette pollution massive constatée sur plusieurs kilomètres, les associations de protection de l’environnement en appelaient à un respect strict de la réglementation en vigueur et se sont donc constituées parties civiles. Elles ont pu obtenir réparation du préjudice subi, à l’instar de l’ONF également partie civile au procès.

Cette condamnation est d’autant plus importante qu’elle met en relief la négligence vis-à-vis de la protection de l’environnement des gérants, la famille OSTORERO, également à l’origine du projet Espérance avec une de leurs autres sociétés minières, la Compagnie Minière Espérance. « On parle tout de même d’un Montagne d’Or bis en partenariat avec la multinationale américaine Newmont. Il semble aujourd’hui inconcevable que l’on puisse accepter un projet de méga-mine très polluant à des gérants peu regardants surles normes environnementales sur leur mine en activité. » déclare Manouchka PONCE, coordinatrice de Guyane Nature Environnement.

Les associations se félicitent ainsi d’une telle décision qui reste historique en matière d’extraction aurifère en Guyane et espère que celle-ci restera dissuasive vis-à-vis des risques que font encourir une telle activité sur les milieux naturels en Amazonie.

He was criticized in particular for having intentionally opened the dikes causing a significant spill of mud into the stream, thus suffocating all living organisms present.
Faced with this massive pollution observed over several kilometers, environmental protection associations called for strict compliance with the regulations in force and therefore became civil parties. They were able to obtain compensation for the damage suffered, like the NFB, which was also a civil party to the trial.

This condemnation is all the more important as it highlights the negligence towards the protection of the environment of the managers, the OSTORERO family, also at the origin of the Espérance project with one of their other mining companies. , the Compagnie Minière Espérance. It now seems inconceivable that we can accept a highly polluting mega-mine project from managers who pay little attention to the environmental standards of their operating mine. »Declares Manouchka PONCE, coordinator of Guyane Nature Environnement.

The associations therefore welcome such a decision, which remains historic in gold mining in French Guiana, and hope that it will remain dissuasive with regard to the risks that such activity poses to natural environments in the Amazon.
