ILGALAC : Lutte contre l'homophobie et la transphobie

Pour la première fois, l'Association Internationale des Gays, Lesbiennes, Bi et Trans en Amérique Latine et Caraïbe (ILGALAC) a invité les militants de Martinique, Guadeloupe et Guyane à participer à sa conférence annuelle. Cette démarche correspond à la volonté de l'ILGALAC de développer des relations plus denses et plus profondes avec les territoires français d'Amérique par-delà la barrière de la langue.

Rencontre avec l'Expert Indépendant de l'ONU

La présidente de KAP CARAÏBE Céline FAURE, le délégué territorial du Refuge Guyane et coordinateur Outre-mer Steven KUZAN et le doctorant à l'université des Antilles et militant au sein de Gay Attitude Guyane Moïse MANOEL participent ainsi à la VIIIème Conférence Régionale de lutte contre l'homophobie et la transphobie qui se tient cette année à Bogota, en Colombie.

Une rencontre avec l'Expert Indépendant sur l'Orientation Sexuelle et l'Identité de Genre de l'Organisation des Nations Unies (ONU), Victor Madrigal-Borloz, a été organisée pour lui faire connaître la situation des LGBT+ en Martinique, Guadeloupe et Guyane.

Parmi les problèmes évoqués, figurent la situation très spécifique des Outre-mer : une forte influence post-coloniale sur les mentalités, une application des lois qui reste différenciée entre l'Hexagone et les Outre-mer et une volonté politique qui demeure trop inconstante et changeante selon les différents responsables en poste. Mesurer le taux de violences s'avère également très difficile : les victimes ne souhaitent pas porter plainte ou les autorités refusent de les enregistrer si bien qu'en Martinique il n'y a par exemple aucun chiffre concernant les LGBTphobies. Des faits divers dramatiques, comme la séquestration puis torture d'un homme homosexuel en Guadeloupe ou les brûlures au fer à repasser subies par un autre dans le même département, viennent cependant rappeler que l'homophobie est réelle. Ces violences peuvent survenir dans l'espace public mais peuvent également être intrafamiliales. Enfin, le cas des nombreux réfugiés haïtiens LGBTI en
Martinique mais surtout en Guyane (plus de 100 demandes d'aide auprès du Refuge depuis le début de l'année) fut évoqué avec l'Expert Indépendant.

Actions des militants ultramarins pour lutter contre l'homophobie

Les militants ont présenté leurs différentes actions pour combattre l'homophobie. KAP CARAÏBE, qui organise de nombreux ateliers culturels pour permettre de libérer la parole des victimes, va ouvrir un local d'accueil mi-décembre et une ligne d'écoute téléphonique mi-janvier. Le Refuge Guyane, qui accueille et loge des jeunes LGBTI victimes de discriminations, forme également les services de l'Etat à la lutte contre l'homophobie : suite aux interventions du Refuge, la police de Cayenne s'est ainsi dotée d'un référent LGBT. Enfin, Gay Attitude Guyane, avec le soutien du Refuge, tente d'organiser la première Gay Pride de Guyane en mai prochain.

Coopération futures entre l'Expert Indépendant et les militants ultramarins

Victor Madrigal-Borloz, qui a posé de nombreuses questions aux militants, s'est dit très heureux de les avoir rencontrés car il ne connaissait pas la situation des LGBTI au sein de ces territoires. L'Expert Indépendant de l'ONU a rappelé ses différentes fonctions.

Nommé par le Conseil des Droits de l'Homme de l'ONU et doté d'une totale liberté par rapport aux Etats comme par rapport aux organisations internationales, l'Expert Indépendant rédige différents rapports thématiques et géographiques sur les questions d'homophobie et de transphobie. Notant qu'il n'avait reçu aucune contribution pour l'ensemble de la zone Caraïbe lors de ses précédents rapports, il a invité les militants ultramarins à lui envoyer des éléments en vue des prochains rapports thématiques qu'il écrira (thérapie de conversion, droit à la santé, colonialisme et impact sur les LGBTI...).

En parallèle à ses fonctions d'observation, l'Expert Indépendant peut également être saisi pour des plaintes relatives à des violations de droits fondamentaux par les Etats. Les informations qui lui sont transmises sont confidentielles et peuvent concerner des violations déjà parvenues ou pouvant parvenir. L'avocat costa-ricain a ainsi déclaré que les militants ultramarins pouvaient le saisir pour toute violation de droits de personnes LGBTI qu'ils pouvaient connaître sur leurs
territoires.

Enfin, Victor Madrigal-Borloz a annoncé vouloir se rendre au sein des Outre-mer français pour mieux comprendre la situation et les formes de discrimination ressenties sur place.

For the first time, the International Association of Gay, Lesbian, Bi and Trans in Latin America and the Caribbean (ILGALAC) invited activists from Martinique, Guadeloupe and Guyana to participate in its annual conference. This approach corresponds to ILGALAC's desire to develop deeper and deeper relations with the French territories of America beyond the language barrier.

Meeting with the Independent Expert of the UN

The president of KAP CARAÏBE Céline FAURE, the territorial delegate of Refuge Guyane and Overseas coordinator Steven KUZAN and the doctoral student at the University of the West Indies and activist at Gay Attitude Guyane Moïse MANOEL participate in the VIII Regional Conference against homophobia and transphobia taking place this year in Bogota, Colombia.

A meeting with the Independent Expert on Sexual Orientation and Gender Identity of the United Nations (UN), Victor Madrigal-Borloz, was organized to make him aware of the situation of LGBT + in Martinique, Guadeloupe and Guyana.

Among the problems mentioned, are the very specific situation of Overseas: a strong post-colonial influence on mentalities, a law enforcement that remains differentiated between France and the Overseas and a political will that remains too inconsistent and changing according to different officials in office. Measuring the rate of violence is also very difficult: the victims do not want to lodge a complaint or the authorities refuse to register them, so that in Martinique there is, for example, no figure for LGBTphobia. Dramatic events such as the sequestration and torture of a homosexual man in Guadeloupe or iron burns suffered by another in the same department, however, recall that homophobia is real. Such violence can occur in the public space but can also be intrafamilial. Finally, the case of the many Haitian LGBTI refugees in Martinique but especially in French Guiana (more than 100 requests for help from the Refuge since the beginning of the year) was discussed with the Independent Expert.

Actions of overseas activists to fight against homophobia

The activists presented their various actions to fight homophobia. KAP CARAÏBE, which organizes numerous cultural workshops to free up victims' voices, will open a reception area in mid-December and a crisis line in mid-January. Refuge Guyane, which houses and shelters young LGBTI victims of discrimination, also trains state services in the fight against homophobia: following the interventions of the Refuge, the police of Cayenne thus has a referent LGBT. Finally, Gay Attitude Guyana, with the support of the Refuge, is trying to organize the first Gay Pride in Guyana next May.

Future cooperation between the Independent Expert and the ultramarine activists

Victor Madrigal-Borloz, who asked the activists many questions, said he was very happy to have met them because he did not know the situation of LGBTI people in these territories. The Independent Expert of the UN recalled his various functions.

Appointed by the UN Human Rights Council and given total freedom from states and international organizations, the Independent Expert drafts various thematic and geographical reports on issues of homophobia and transphobia. Noting that he had received no contributions for the whole Caribbean area in his previous reports, he invited overseas activists to send him elements for future thematic reports he will write (conversion therapy, right to health, colonialism and impact on LGBTI).

In parallel with its observation functions, the Independent Expert may also be seized for complaints relating to violations of fundamental rights by States. The information transmitted to it is confidential and may concern violations that have already reached or are likely to arrive. The Costa Rican lawyer stated that the overseas activists could seize him for any violation of the rights of LGBTI people they could know about their territories.

Finally, Victor Madrigal-Borloz announced that he wanted to visit French overseas territories to better understand the situation and the forms of discrimination felt on the spot.
